Thanks for visiting the Tonista site and for reading the Terms of Service (TOS), Copyright and License notices. This agreement is effective June 6, 2010. It supersedes any previous terms.
The Upshot
For all the tl,dr (too long, didn’t read) people, here it is in a nutshell. The site and its contents are protected by copyright, mostly full, but a few things are creative commons with a share-alike license. It helps to pay attention. Crafts and downloads are intended for personal use, and if you want to use my photographs, graphics or drawings, you need to ask me first. You can of course link to stuff and use thumbnails. More about that below. There’s no extra charge for using my patterns as teach materials, but I do ask for credit. See the teacher license. If you’d like to use any of my work for commercial purposes (making money), please contact me. It’s okay, I’m quite flexible. Craft-alongs, charity work and the like are probably fine as long as you are not planning production on a large scale. If your charity is along the lines of “Mama needs an alligator bag” I’d say that’s not in the spirit of charity. Please do let me know if you use something for charity, as I like to know for warm fuzzies and maybe I can give you a shout-out or something. I do request that you do give me credit for original work and a link back. If you want to use something in full for content, commercial or noncommerical, please contact me, I’d be happy to hear what you have in mind and work something out. For 95% percent of the people who visit, this probably covers things sufficiently. For more specific details, keep reading.

All content on this website is protected by copyright. All rights reserved unless explicitly noted otherwise. Some items are offered under a creative commons license or used with permission. In those cases the item will be labeled accordingly. This includes but is not limited to photographs, patterns (free and for sale), drawings, original fonts and writing entries. This means you may not sell, copy, reproduce, redistribute, recreate, modify, transmit, display, edit, adapt, or create derivative works and materials for the content offered without my express permission. It’s very simple, really. If you would like to use it, ask me. If it has a Creative Commons License, please follow the terms specified by that license. If you would like to purchase a cottage or angel license to knit or crochet items for sale please see the that section of the TOS below or contact me.
Photographs
You may not download my photographs. See above. You may link to the page where they reside. You may use a low resolution thumbnail of the image to represent that link. If you want to use an image for commercial purposes, then you need to get my permission first, and you must include a link back to this blog.
Hotlinking/Linking
You can of course link to this site. You may not hotlink the images. If you don’t know what hotlinking is, or why it’s different from regular linking, this website describes it clearly and succinctly. Here’s the wikipedia entry. As I don’t host my own pictures, bandwidth isn’t an issue for me, but hotlinking is still rude and unnecessary so please don’t do it. You may upload a thumbnail of a pattern picture or a photo to your own host for the purpose of linking back to this website. Again, you may of course link back to this site using a normal hyperlink. That said, comments left for the sole purpose of linking back to your site and spam will be removed without warning or notice.
Fonts
Terms for the fonts are included in the download package for each one. The general licenses for free fonts and purchased fonts can also be viewed online.
Knitting and Crochet Patterns and Charts
Patterns are made available as PDF files. Many programs can read PDF files. If you don’t have one, download the free reader from Adobe.
Free patterns
Patterns are offered without warranty AS IS. The free patterns have not been tested and it is generally assumed that you can figure the basics out on your own. They are closer to my notes than they are to properly written patterns and may contain errors. I try to fix them as I get a chance, but there are no guarantees.
You are free to e-mail me for help with any patterns offered, free or for sale. I do respond as quickly as I can, but do keep in mind that I have a day job so I’m not available 24 hours a day. Correspondence may be slower on weekends and holidays. For more information see the support section below. By downloading, installing, copying, printing, buying, or otherwise accessing a pattern from this site or from the Tonista store here or on Ravelry, you are agreeing to the terms set forth in the Terms of Use. If you do not agree with the terms, then please, do not buy or download the pattern.
All patterns
Copies
You can download one copy of a pattern for personal, non-commercial use.
You can also create and store up to 3 copies of the pattern for backup purposes on digital media (like a computer drive), or a hardcopy printed file. Copyright, license and/or any support files must be included intact with the backup copy(ies).
You may make as many items as you like from the pattern for yourself or as gifts for others.
You may make as many items for charity as you like provided the items go to the recipient of the charity.
If the items are intended to RAISE MONEY for a charity, the items must be made by you personally and offered for purchase by you personally and not another party or individual. The item must be acknowledged on the item(s) person as a Tonista Pattern and Tonista’ contact and licensing information must be passed on intact. Your identity as the maker must be clearly identified with the item. Under the terms of this agreement you must also contact me if you intend to raise money or fundraise with the pattern. Causes deemed to not fall under the traditional definition of Charity will be deemed Commercial rather than Charitable use. In other words, you can’t use Tonistas patterns to raise money because you need a new pair of shoes and a couch, for example. The pattern itself may not be sold to raise funds.
If you give a FOR SALE pattern away all rights and licenses attached to the patterns are transferred to the new owner. Support, however, will not be offered to the new owner (see below). You no longer retain any rights to it and may not keep a copy. If you lend a pattern to someone, this counts as giving it away. You can not keep a copy. When the recipient returns it to you, they are giving it back and they may not retain a copy.
FREE patterns may be given away or transferred freely as long as the contact, licensing and copyright information remain intact.
You may not resell the pattern for profit.
Support
I offer support for patterns via email. This includes clarification of the instructions provided. I will respond to requests for support via email as quickly as possible, with the understanding that there are no guarantees about a time frame for response. If you need help with a teaching or have “how-to” questions I can provide links to helpful resources and tutorials and have a running list of a few common ones that may help with techniques found in my patterns on the site. I can not, however, provide lessons. If you have purchased a pattern, support will only be provided via the email address and/or Ravelry username Tonista has on file for you. If ownership of the pattern is transferred to another individual support is not transferred. If the pattern is a gift and you would like support transferred to the recipient, Tonista must be contacted and notified of this at the time of purchase.
Commercial Use
If you would like to use Tonista patterns for commercial purposes, for instance to make or sell items online, in a brick and mortar or or out of your house You must contact me for permission first.
Making items on commission is allowed and not considered commercial use. For the purposes of this agreement, “commission” is defined as the patterns purchaser buying the pattern and hiring another to make them the item for personal use. The commissioner must be the purchaser of the pattern and is compensated by another for time, materials and service. The person making the item may not sell the pattern. If the pattern is being made with intent to sell to another and has not been commissioned by someone who owns the pattern, under this agreement, this is considered Commercial use.
The patterns may not be bought for the purposes of manufacturing the items for mass production.
Angel Policy for independent sales
Unless you have made a written agreement with me, you may not make items from my patterns and offer them for sale online. This includes outlets like Ebay and Etsy.
I do have an angel policy for independent brick and mortar stores
First, you still must contact me before offering anything for sale. You may sell up to 12 items made from the pattern per year. This number may vary depending on the item and our agreement. The items must be made by you the pattern’s owner, personally by hand, and offered for sale by you personally, directly to the public and not to or via a reseller, manufacturer, company or corporation.
Using Patterns for classes
Free patterns may be used in classes as long as the patterns are used as downloaded with the attribution, contact and licensing information intact. (Especially if you photocopy them. Your student would probably appreciate being able to download and print a nice fresh copy.) The pattern MAY NOT be sold as part of the materials for the class or used to sell other materials needed for the class. Students must be made aware that the pattern is available for free.
Sale patterns may be used for classes ONLY if the students each purchase their own copy of the pattern directly from Tonista. If you’d like to purchase multiple patterns specifically to teach a class, contact Tonista to make an arrangement. BUlk purchases may be subject to a discount.
Yarn Stores/Sellers Suppliers
Free patterns can be offered as a FREE incentive with purchase but the attribution, contact and licensing information must remain intact.
For Sale patterns MAY NOT be used to promote yarn sales. If you think Tonista patterns would make a good fit with one of your yarns contact me about a possible arrangement.
If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable. This Agreement shall be governed by and construed under the laws of the United States.
